COMPREHENSIVE PRIVACY POLICY

EUROAMERICA IN MOTION, S.A. DE C.V. (hereinafter "EUROAMERICA" or the "Data Controller" interchangeably), in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the "Law"), its Regulations (hereinafter the "Regulations"), in order to guarantee the processing of your Personal Data in adherence to the principles of legality, purpose, loyalty, consent, quality, proportionality, information and responsibility, as well as to guarantee your privacy and the effective exercise of ARCO rights, informs you of the following:

EUROAMERICA, with address at Armando Birlain 2001-8C C.P. 76090, Querétaro, Qro, shall at all times be the Data Controller for everything related to the processing of Personal Data that has been disclosed to date or that may come to be disclosed, for any reason whatsoever.

For the purposes of this Privacy Policy, Personal Data shall be understood as: any information concerning an identified or identifiable natural person. A person is considered identifiable when their identity can be determined directly or indirectly through any information.

PURPOSES AND USE OF YOUR PERSONAL DATA

 

The Data Controller may request and collect Personal Data related to the following categories: (i) identification data, (ii) contact data, (iii) employment data, (iv) academic data, (v) financial or asset data, (vi) sensitive data. These Personal Data may be collected directly through any physical or electronic communication or documentation delivered or sent by you to EUROAMERICA, directly or indirectly through technologies implemented [on our website (cookies) --- keep only if applicable], as a consequence of your relationship with EUROAMERICA.

The following primary purposes are essential for the existence, maintenance, and compliance of the commercial relationship between EUROAMERICA and you:

2. Compliance with legal and tax obligations.  

3. Administrative, financial, and accounting management.  

4. Provision of services and delivery of products.  

5. Response to inquiries, requests, and customer service.  

6. Maintenance of the commercial relationship.

Secondary Purposes

9. Commercial, advertising, or informational communications regarding products and services offered by EUROAMERICA.

 

Secondary purposes are not essential for the existence, maintenance, and/or compliance of the commercial relationship between you and the Data Controller; therefore, at any time, you may express your refusal regarding the processing of your Personal Data for these purposes by sending an email to the email address: info@euroamerica-im.com. This request must contain at least what is provided in items a) and b) of the section "Means to Exercise ARCO Rights".

TRANSFER OF PERSONAL DATA

The transfer of your Personal Data to third parties may be carried out within the national territory or abroad without your consent in the exception cases provided by Law.

In the event that EUROAMERICA requires to perform a transfer of your Personal Data outside the exception scenarios provided by Law, your prior consent will be requested, and you may accept or reject said transfer.

Security measures

The Data Controller shall adopt each and every one of the administrative, physical, and technical security measures necessary to safeguard your personal information; likewise, in the event that a third party needs to know such information, EUROAMERICA will oblige said third parties to comply with this Privacy Policy, as well as to adopt the administrative, physical, and technical security measures established in the Regulations, in order to protect the Personal Data that you voluntarily provide to us against any damage, loss, alteration, destruction, or unauthorized use, access, or processing.

The Data Controller, even after the termination of the relationship held with the data subject, commits to maintaining the confidentiality thereof.

Means to exercise ARCO rights

In case you, or your legal representative, as the holder of your Personal Data, wish to exercise the rights of Access, Rectification, Cancellation, or Opposition, we request that you send the request for the exercise of the corresponding right(s) via email to the Personal Data Processing Officer of EUROAMERICA at the following email address: info@euroamerica-im.com, or send a written request to our address.

Said request must contain at least the following information:

​

i. Name and address or email address, in order to communicate the response to your request within the deadlines established by Law;

ii. Copy of your voter ID, passport, driver's license, professional license, or any other document that proves your identity or proves the legal standing of your representative;

iii. Clear and precise description of the Personal Data concerning which you seek to exercise any of the ARCO rights;

iv. Clear and precise description of the right you seek to exercise through your request; and

v. Any other element or document that facilitates the location of said Personal Data.

Once the request in question is received, EUROAMERICA will have a period of 20 business days to respond to the request; in the event that it is determined to be admissible, it will become effective within 15 business days following the communication of the response to the data subject. Otherwise, the reason why it was not admissible will be communicated, leaving your right intact to request the exercise of your rights again.

Revocation of consent and limitation of use and disclosure of Personal Data.

​

You may at any time revoke the consent granted to EUROAMERICA for the processing of your Personal Data or limit the use and disclosure thereof, by sending an email to the following address: info@euroamerica-im.com, or by submitting your request in writing at the address of EUROAMERICA, which must contain at least points a) and b) indicated in the requests for ARCO rights.

STORAGE OF YOUR PERSONAL DATA

EUROAMERICA, by itself or through third parties hired for this purpose, may store your Personal Data in databases located in Mexico or abroad, in accordance with the timeframes and provisions specified by applicable legislation, including those of a fiscal nature and for the prevention of money laundering and terrorist financing.

EUROAMERICA will at all times adhere to the principles provided in the applicable legislation regarding personal data protection, and will not store your Personal Data longer than necessary for the fulfillment of its obligations. Once said period has expired, it will proceed to delete the data subject's Personal Data.

USE OF COOKIES AND OTHER SIMILAR TECHNOLOGIES

 

EUROAMERICA may collect Personal Data on its website through the use of cookies, which have, among other purposes, the objective of knowing regular user behavior and preferences in order to provide a better experience and service. You may disable the use of cookies by clicking the corresponding button on the tab that will appear upon entering our website, or by following the procedure established by the internet browser you use.

MODIFICATIONS TO THE PRIVACY POLICY

 

The delivery of your Personal Data to EUROAMERICA implies acknowledgment and acceptance of this Privacy Policy. EUROAMERICA reserves the right to modify this Privacy Policy, in which case the updated version will be available for consultation at the Data Controller's address, or you may request it at the email address: info@euroamerica-im.com.
